Welcome to the mobile application (AI Optimizer, hereinafter ‘the App’) provided by Velocity Pro Engine S.L. (hereinafter ‘Velocity Pro Engine’, ‘we’, “us”, ‘our’). These Terms and Conditions govern your access to and use of the App as well as any service, feature or functionality we offer through it.
By downloading, installing, opening or using the App, you agree to be legally bound by these Terms. If you do not agree with any of these terms, you should not use the App.
1. LICENCE OF USE
Subject to your compliance with these Terms, Velocity Pro Engine grants you a limited, non-exclusive, revocable, non-transferable and non-sublicensable licence to access, download and install the App on your mobile device for your personal, non-commercial use.
You may not:
- Rent, sublicense, sell, transfer, modify, adapt or attempt to extract the source code of the App.
- Distribute, transmit or make the App available through networks or other means that allow its use by multiple persons or devices.
2. INTELLECTUAL PROPERTY
The App and all its contents, trademarks, logos, copyrights, designs, interfaces and other intellectual property elements belong exclusively and entirely to Velocity Pro Engine or its licensors.
You do not obtain any rights to the intellectual property of the App other than the strictly limited licence described in this document.
3. CHANGES TO THE APP AND SERVICES
Velocity Pro Engine may, at any time and without prior notice:
- Modify, temporarily or permanently disable features of the App.
- Change the content, interface or technical requirements.
- Suspend or terminate access to the App.
We are not responsible for any damage or loss resulting from such modifications.
4. YOUR USE OF THE APP AND DEVICES
To use the App, you need:
- A compatible device and an internet connection.
- To keep your device secure and up to date.
You assume all costs associated with the use of data and network services necessary to access the App.
5. PAYMENTS AND SUBSCRIPTIONS
Some features of the App may require payments or subscriptions within the App. These payments are also governed by the policies of the app store (e.g. Apple App Store or Google Play).
You agree to manage your payments, renewals and cancellations from the relevant platforms.
6. DISCLAIMER
The App is provided ‘as is’ and ‘as available’. Velocity Pro Engine does not guarantee that the App will be uninterrupted, error-free or that it will meet specific expectations.
To the fullest extent permitted by law, we assume no responsibility for any loss, direct or indirect damage, or for the use or inability to use the App.
7. THIRD-PARTY PROVIDERS
The App may contain services or features provided by third-party providers (e.g., analytics, advertising, or cloud services). You are also subject to the terms of those third parties.
8. DATA COLLECTION AND USE
Use of the App may involve the collection and processing of personal data in accordance with our Privacy Policy, which forms an integral part of these Terms.
9. TERMINATION
We may suspend or terminate your access to the App at any time if you breach these Terms. Upon termination, you must stop using the App and delete any downloaded copies.
10. APPLICABLE LAW AND JURISDICTION
These Terms shall be governed by and construed in accordance with Spanish law, without prejudice to applicable mandatory rules. Any dispute shall be submitted to the competent courts of Spain.
The parties expressly waive any other jurisdiction and submit to the Courts and Tribunals of the city of Barcelona (Spain) for the resolution of any controversy or dispute that may arise.
In accordance with Articles 38, 39 and 40 of Law No. 78-17, known as the Data Protection Act, of 6 January 1978 (Law No. 78-17), amended by the Law of 6 August 2004, the Customer has the right to oppose, access, rectify and delete all personal data concerning him/her and obtained by the publishing company during the use of the service.
